William Sullivan of Connecticut murdered his girlfriend's mother with a baseball bat and a knife. In his trial he plead not guilty due to mental illness (borderline personality disorder). The jury did not side with him and he was found guilty today. Gregory Morris, a Fresno lawyer, claimed depression and borderline disorder caused him to scam his clients. His case is still pending. An arsonist in Pennsylvania recently used borderline as his defense. A couple who committed a double murder are seeking a retrial because the jury wasn't informed of their borderline personality disorder. Question to the forum: is borderline a viable defense against criminal prosecution? Are those so afflicted not responsible for their actions due to mental illness? |

| Well, it's hard to say... The excess anger and morbid thoughts that come with BPD may have something to do with it. Could be sparked and light the flame of death. Then again, it's so difficult to tell now a days whether or not someone really is suffering from a disorder... | |

| I'm sure it is down to the lawyers just clutching at straws to get thier client off. However for the real sufferers it is not fair. My rages have been so bad before I am thankful I don't live in the USA and have easy access to guns! For one I don't think I would be here writing this right now. It is scarey to think how angry I can get as normally I wouldn't hurt a fly. | |

Same here telula, on the anger thing. I have almost killed my sister in her sleep before, but I cry when see roadkill. Scary changes, aren't they? |

I don't think the disorder should be a pardon for murder!!!! Sounds like a lame excuse to me. I just can't buy it. But I'm not very educated on the subject so maybe there's more to learn. Wow! I've never almost killed anyone, but I have had the urge to slap Jo. This last episode I was able to deesculate my anger. I calmly asked him to leave and we could talk about it when we both weren't so upset. He didn't leave but he did sleep on the couch and was gone in the morning without incident. I'm worried that I'll weaken and ask to see him again. It's so wierd cause I know It will only lead to something ugly,and probably violent. So why would I even consider it? Is this part of the disorder? la |

Well I think people with this disorder may not even be aware of it. They know something is wrong but going too long without treatment is bad. I know someone with the disorder but will never admit anything is wrong and I think that makes it worse. You have to recognize that there is a problem and admit it and get help. |

| BPD should not be used to get a lighter sentence. Although a severe mental illness when it comes to breaking the law, they do know right from wrong. | |

Maybe their should be more high security, prison-like mental health facilities for these personalities. They should not be out on the streets until under control. And with the proper care, they could hope one day to at least have part of a life. If they were faking it, well, they're still where they need to be. |

I wanted to add that since reading about the 'projection' habits of BPDs, I'm getting really nervous about my husband. He idolizes gangster series like the Wire and Sopranos. When he watches something I like, he makes weird comments about what's happening on the screen, like "Do you ever think about killing someone? I worry about you." When we were first married, he'd say, "Your going to kill me in your sleep." And when he'd get a stomach-ache, his first thought would be that I poisoned him -- even though I rarely even cook his food, LOL. He'd mostly gotten over this, but he started up again with it recently. |

| My wife is borderline. We have been married 31 years because I am calm and reasonable. I doubt that borderline (in her case alone) would cause a person to kill someone. It could cause her husband to kill however. A borderline has such a difficulty with anger and relationships that I'm sure the long term mate might use it as a defense. As An attorney (University of Utah School of Law) I could pose an incredible defense for this. I have a genius level IQ however. That is not to say others could however. I quit law because of the impulse to lie and use my position against others or in an inappropriate manner. Many attorneys do this. In fact, if I were to gauge the numbers, In criminal defense, I would have to say that fully 90% of those I have spoken with are willing to do that and many do. In the rest of the law, the range is lower, but perhaps 70% at the minimal low. In the United states, if lawyers were not running the law, they would be extremely tightly regulated by intelligent and non benefiting others. Our problem here is greed. Our society is run on this--the government runs on fear and greed and insecurity. Were I not invested heavily here I might leave. I have lived in six other countries and although to some extent the situation exists, it is not as rampant. | |

Maybe it might, but not always. In a Duke university case, a woman made false accusations of rape and caused a s---storm for the whole faculty. When the courts finally discovered that her allegations were false, she pled insanity that she was a clinical narcissist and couldn't help herself, so she escaped punishment. This particularly bugs me. "Sorry, its not my fault I only care about myself and have the impulse to f--- someone over when they fail to satisfy me." How psychology tries to authoritize simple toxic personalities as if its an actual mental illness is so f---ing corrupt. Same thing with BPD. If you can hold down a job and live as an independent adult, then you are more than capable of rational thought. Whining and passing yourself off as some innocent child with a mental problem gets you nowhere, and sooner or later more and more courts will start rejecting this popular fad. In other words: grow the f--- up. If you murdered someone and got caught, you take your sentence like a man and not spend your life in a padded cell like an eternal loser. |

I can understand their defense regarding BPD if in fact they do suffer from it. I'm really struggling at the moment; Some days, I want nothing more than to stab or beat someone to death. I am a calm soul and this scares the s--- out of me because I believe that I could actually do it. ANY TIPS PLEASE???? |
